Notary FAQs

  What is a Notary?

A Notary Public is an official of integrity appointed by the state government, commissioned by the secretary of state to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents.

   What is an Acknowledgment?

The purpose of an acknowledgment is for a signer, whose identity has been verified, to Declare to a Notary that he or she has willingly signed a document. The signer must physically appear in person at the time of the notarization to be positively identified and declare the signature on the document is his or her own, that it was willingly made and the provisions in the document are intended to take effect exactly as written.

  What is a Jurat?

The purpose of a Jurat, also known as a “verification upon oath or affirmation”, is for a signer to swear to or affirm the truthfulness of the contents of a document to a Notary or notarial officer. The Jurat is administered or a spoken oath or an affirmation, and the signer must respond out loud.

  How Does a Notarization Work?

Notarization is an official fraud-deterrent process that assures the parties of a transaction that a document is authentic, and can be trusted. It is a three-part process, performed by a Notary Public, that includes cross-checking, certifying, and record-keeping. The Notary will identify the signers, confirm that the singers understand what they are signing, witness the signature(s), log the notarization act in the journal, and complete a Notarial Certificate.

What is a Loan Signing Agent?

A Notary Signing Agent is a Notary who is specially trained to handle and notarize loan documents. For lenders, Notary Signing Agents are the critical final link to complete the loan. A Notary Signing Agent is hired as an independent contractor to ensure that real estate loan documents are executed by the borrower, notarized, and returned for processing on time. Completing this critical part of the loan process enables the loan to be funded.
